Long <br />Division Dueclor <br />OF~~~R <br />I have been reviewing the materials submitted by you to-date in regards to the above named permit <br />action. This includes new materials the Division received on April 21, 1997. As you have been <br />informed already by staff in Denver, the application has not been found to be complete (referring to <br />letters to you dated April 9 and 30, 19971. It is normally not my task to review applications before <br />they have been found complete, but I have agreed with Lavern Lemay to assist you during this step <br />and try to clarify some of the "technical" issues during her "completeness" review. This letter will, <br />therefore, list some of Lavern's completeness issues which are still outstanding, and direct you <br />toward clarifying some of my technical issues. Unfortunately, we have at least two actions occurring <br />presently: a transfer of operator and a conversion. Wherever necessary, for efficiency or clarity, I <br />will refer to the Rules and/or to Lavern's above-mentioned letters to you. <br />As Lavern stated to you, in order for Malouff Construction to amend the permit, it must be transferred <br />from Hi-Valley Paving. This must be done before the 112 conversion can occur. This change of <br />operator is accomplished by you providing the completed "Succession of Operator" forms. If it is <br />merely a name change, the usual $100 fee will be waived. Lavern has identified errors on the first <br />page of the Performance Warranty form which must be corrected; I have noted some also. First, the <br />two places where the form's first page asks for the name of the operation, it is neither "Hi-Valley <br />Paving" nor "Malouff Construction Inc." You should write "Malouff Pit" there instead. Also, the <br />"operator" is not "Stephen Malouff", but should be "Malouff Construction Inc." <br />The replacement bond, as Lavern explained, must be from Malouff Construction Inc., if that is to be <br />the new permittee (operatorl. There may be other items to be completed before the transfer is <br />approved. Until the proper changes have been fully approved, however, any conversion materials <br />must be provided in the name of the existing permittee, "Hi-Valley Paving". Please refer to both of <br />her letters to you, and to the specific language on the transfer package, to ensure you have fully <br />provided what is required. If you have questions about the transfer, please contact Lavern. <br />Regarding the conversion application itself, you have already received some preliminary material from <br />me, consisting of a set of your maps upon which I wrote notes, suggestions and questions. In this <br />letter I have listed additional items below, whose headings correspond to the location in the <br />application or exhibits where they belong. <br />cont. <br />
