Mike Altavilla faxed me a letter outlining their comments/concerns regarding NOV C-96-
017. The NOV was issued to Seneca Coal Co. on August 30, ]996. In summary, Seneca is
modifying Routt County Road 27 and 27a to allow a 60' wide passage for the dragline to
walk from the Seneca II mine to the Yoast Mine. On the cut slope of Routt County Road
27a, Seneca disturbed an additional 20' wide, 25'-30' high and 1000' long along the length
of the road. This material is being place along Routt County Road 27, just prior to entrance
of the mine area. The NOV was issued for; failure to conduct mining Operation within the
permit area along Routt County Road 27a, implementing a revision prior to approval,
failure to provide specification and geotechnical analysis on the road cut and failure to
provide a reclamation plan for the road cut.
In Seneca's letter, all of our names were mentioned regarding Routt County Road 27a. This
is the road that leads into the Seneca II Mine Office area. T'he operator basically contends
that the anticipated disturbance was mentioned to all of us on numerous occasions in order
to walk the dragline. I have spoken with each of you individually regarding these
conversations, and it appears to differ from what the operator has stated in the letter.
Please read over the attached letter, and provide me comments regarding your recolection
of conversations with the operator regarding the "dead head" route or modifications of
County Road 27a. Your comments will go into the NOV file and may possibly be used
during the assessment conference. Seneca is requesting a conference as soon as possible
regarding three NOV's, so I would like something by September 10, 1996.
