Long <br />Division Dveclar <br />This afternoon I spoke with Christine Johnston of Mountain Coal Company. I asked her whether <br />there has been any progress regarding the additional permitting required with NOV C-96-013. She <br />stated that there was no progress with any permitting and that they might get something done next <br />week when Scot Anderson comes to the site. <br />I reminded Christine that MCC had until July 31 to both permit and implement any changes. <br />Christine said she thought the NOV only specitied permitting, not implementation. <br />I asked Christine whether MCC continued to use the unpermitted subsoil pile, and she replied that <br />the west soil pile had been used to reclaim the west flank of the refuse pile. I asked her again <br />about the unpermitted pile (east), and she stated that the east pile is where most of the stored soil <br />material now resides. I asked why MCC proceeded with the use of an unpermitted pile, even after <br />the NOV had been written. Christine stated that she saw no difference between an east pile or a <br />west pile. I explained that the east pile was no[ pernritted, and I was concerned that MCC chose <br />to use the pile and has not provided any additional permitting. <br />Christine stated [hat she wasn't sure exactly what was occurring on the ground, so I asked <br />Christine to have Notm Avery give me a call this afternoon. <br />DABlbjw <br />\env\C96013.one <br />
