As required, <br />the applicant published a notice in a local newspaper on December 24 & 31, 1997 and January 7 & 14, <br />1998. The 20-day comment period expired on February 3, 1998. The Division received one (1) objection <br />letter and two (2) letters of concern prior to the expiration of the comment period. The Division received <br />two (2) letters of concern after the comment period expired. <br />The list of objections submitted by Mr Willard Travnicek are as follows: the acreage of the amended <br />application; the possible affect on groundwater (well and subirrigation); dust particulates blowing from <br />the crusher toward his house; excavating on or near a creosote site; affect the creosote may have on his <br />health; the aesthetics and quality of life being degraded and; the storing of used tires and old equipment <br />near the road (a copy of his letter is attached). <br />A List of concerns was submitted on February 2, 1998 by Mr and Mrs Forrester. The Forresters pointed <br />out that they do not oppose the application.They just want to be assured that their family's health and <br />property values are not effected by the expansion. They express concerns about: subirrigation; their <br />water well; dust and noise created by the crushing operation; truck traffic; creosote particulates blowing <br />through the air; drop in land values and; the use of explosives. <br />The CDOW expressed concerns about the loss of riparian vegetation and subsurface springs which exists <br />in the western portion of the permit area. The Wildlife Statement was received prior to the expiration of <br />the comment period. <br />Mr Steve Shurbet submitted a letter of concern on February 4, 1998 (one day after the comment period <br />expired). He was concerned that the amendment application that was filed at the County Clerk's office <br />was incomplete. He was correct. The initial application was so inadequate I had to send the applicant a <br />five (5) page adequacy letter. Followed by a three (3) page adequacy letter after receiving the applicant's <br />response to the first adequacy letter. Mr Shurbet attended the informal conference but did not submit any <br />additional comments, concerns or objections to the Division within five (5) working days after the <br />hearing so, apparently, he does not have any other concerns. <br />Mr and Mrs Johnson submitted a letter of concern on February 9, 1998 (six days after the comment <br />period expired).
