D2;;i. of tialyral Resources <br />Mr. Jeff Deckler <br />Reclamation Specialist <br />Mined Land Reclamation Division <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />Re: Minor Revision to the New Elk Mine Permit and Permit Revision No. 1 for <br />Utilization of Topsoil Salvaged in the Refuse Disposal Area (RDA) for Placement on <br />the Recently Construction River Diversion. <br />Dear Mr. Deckler: <br />By this letter Wyoming Fuel Company (wFC) is requesting a minor revision for <br />placing topsoil salvaged from the RDA on the recently constructed diversion. <br />• The diversion construction yielded approximately 400 yd3 of topsoil. A total of 2.5 <br />acres of diversion will require revegetation this spring. WFC would like to place <br />approximately 4 inches of topsoil on this 2.5 acres; or approximately 1300 yd3. Thus, 90C <br />yd3 would be taken from the RDA stockpile. Over the life of the RDA, 108,728 yd3 will <br />be removed (see Table III. 5-3 Soil Balance for Refuse Disposal Area, New Elk Permit <br />Revision No. 1). Nine hundred cubic yards equals .55 acre-feet, spread 1 foot; borrowing <br />this topsoil will result in a loss of .009 feet over the entire 60 acre RDA. Since WFC has <br />to comply with permanent program revegetation requirements it is logical this material <br />be utilized for reclamation. <br />Thank you for your consideration. <br />Sincerely, <br />~~ . <br />David M.
