Box 591 <br />Somerset, CO 81434 <br />RE: West Elk Mine (C-80-007); NOV CV-99-005 <br />Dear Mr. Schmidt: <br />This letter is in response to your letter, dated June 8, 1999, in which Mountain <br />Coal Company asked me to consider vacating NOV CV-99-005. I have <br />considered the facts of the alleged violation after reading your letter and <br />reviewing the matter with my staff. Based on the available information I do not <br />believe there is a sound basis for vacating the NOV. Therefore, I am declining <br />your request to vacate the NOV. The comments in your letter have been <br />forwarded to a civil penalty assessment officer for consideration.
