CV-2001-007 and CV-2001-008, Request for Extension of <br />Abatements Deadlines <br />Dear Mr. Long: <br />The abatements specified in the above-referenced NOVs, include the backfilling and <br />reclamation of mud pits containing drilling fluids, as well as soils handling and grading of <br />bermed and heaped soils along the existing and new light-use roads to Oxbow Mining, <br />Inc.'s ("OMI") new methane degasification facilities for the Sanborn Creek Mine. During <br />the past few months, OMI has made several attempts to initiate the repairs committed to <br />in its applications for the degasification site and access construction, as well as is <br />required by the NOV abatements. These attempts have failed because of the snow that <br />remains entrained within much of the bermed soils, and the lack of extended warm, dry <br />weather to sufficiently dry the mud pits and berms. During the past month, <br />thunderstorms have been a regular evening occurrence, exacerbating the wet ground <br />conditions. As such, the ground conditions remain inappropriate for proper handling and <br />rework of the soil materials. <br />To allow additional drying time, OMI had requested extensions of the deadlines to the <br />maximum abatement period (90 days from the date of issuance) to July 19, 2001. <br />These include abatement Nos. 1 and 3 per NOV No. CV-2001-007, and abatement No. <br />2 of NOV CV-2001-008. Although OMI has made significant progress with the <br />abatement of NOV CV-2001-007, the conditions remain too wet to properly complete the <br />remaining work.
