The Secretary of the Interior through OSMRE has
j:aisdiction to issue a entice of violation in
states with approved Iroqrams, where OSMRE, acting
pursuant to sec. 521(a)(1) of the Surface Mining
Control and Reclamation Act, 30 U.S.C. S 1271(a)(1)
(1982), and 30 CFR 843.12(a)(2), issues a 10-day notice
and the state fails m take appropriate action to
ensure abatement of the violation or slew goad cause
for its failure.
