• <br />.t <br />AFFIDAVIT OF KATHLEEN G. WELT <br />• iiiiiiiiiiiiiiuiii <br />999 <br />I, Kathleen G. Welt, being duly sworn, do testify and aver as follows: <br />1. I am the Environmental Supervisor for Mountain Coal Company's West Elk <br />Mine, located near Somerset, Colorado. <br />2. I have held this position throughout the period relevant to NOV C-93-006 -- <br />October, 1990 to January 1993 (the relevant period). <br />3. Throughout the relevant period, Mountain Coal Company performed <br />subsidence monitoring surveys twice a year. <br />4. Each new subsidence report includes the data from all previous subsidence <br />surveys. It has therefore been my practice throughout the relevant period to <br />discard prior subsidence survey reports and keep on file only the most recent <br />subsidence monitoring report. <br />5. During the relevant period I occasionally provided copies of the subsidence <br />monitoring reports to inspectors from the Colorado Mined Land Reclamation <br />Division ("Division") (now the Colorado Division of Minerals and Geologyl. <br />6. Throughout the relevant period, inspectors would review subsidence <br />monitoring data during routine inspections of the West Elk Mine. Division <br />inspectors always found the West Elk Mine to be in compliance with the <br />subsidence monitoring regulations during the relevant period. <br />FURTHER AFFIANT SAYETH NOT <br />Kathleen G.
