The Division has determined that NOV C-93-113
can be vacated. This information is forthcoming. The regulations
only allow for a maximum of 90 days from the date of issue of the
NOV, within which abatement should be accomplished. To extend the
abatement period beyond 90 days requires specific circumstances and
conditions which do not apply to MCC or these violations
(5.03.2(2)(c)). Therefore, the Division will extend the abatement
deadline to November 11, 1993. Both NOVs were issued on August 12,
1993.
Enclosed you will find a form entitled, "Extension of Time for
Abatement Notice" for NOV C-93-112 and 114.
