»° <br />June 23, 2004 <br />Mr. James Burnell <br />Environmental Protection Specialist <br />Colorado Division of Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />RECEIVED <br />JttN 2 82004 <br />Division of Minerals and Geology <br />Re: Permit No. C-1981-022, Oxbow Mining, LLC <br />Request for MR- 73 -Exploration Drillholes located on Reclaimed Blue <br />Ribbon Minesite. <br />Dear Mr. Burnell: <br />Oxbow Mining, LLC (OMLLC) hereby requests a Minor Revision No. 73 to Permit <br />C-1981-022 to perform coal exploration activities on the reclaimed Blue Ribbon <br />minesite. <br />The reclaimed Blue Ribbon Mine (CDMG Permit C-1981-047) is located along <br />Hubbard Creek. It is our understanding that the minesite was closed and the <br />disturbed surface (portals, shop, coal handling, etc.) reclaimed in the mid-1980's. <br />Blue Ribbon has continued to be monitored and maintained under extended <br />reclamation liability by the operator, MINREC Inc. until such time that it is ready <br />for final Phase II and Phase III release. In the interim, Phase I bond release was <br />successfully obtained in 1987. <br />The surface estate occupied by the reclaimed Blue Ribbon minesite is owned by <br />Oxbow Mining, LLC. The entire Blue Ribbon permit area lies within the OMLLC <br />permit area. <br />OMLLC submitted NOI No. X-2004-223-05 to the Division on March 19, 2004. <br />The NOI included a proposal to complete exploration drilling activities at two sites <br />(ECM-04-15 and ECM-04-18) located or accessed across reclaimed Blue Ribbon <br />mining disturbance. One additional site (ECM-04-22) is located on the Elk Creek <br />Federal coal lease but will be accessed across the Blue Ribbon reclaimed area. <br />Refer to PAP Section 2.02 for a description of coal exploration activities. <br />The two proposed drill sites and associated 1,570' of 12 foot wide access roads <br />disturbance totals approximately .66 acres. The reclamation liability carried by <br />OMLLC for the reclamation of the disturbance located on the Blue Ribbon <br />reclaimed area will be an addition to the OMLLC, Elk Creek mine reclamation <br />bond. Bond release activities will be conducted in accordance with CDMG Rule <br />3.03 Release of Performance bonds rather than NOI bond release procedures. <br />3737 Hwy 133 P.O.
