BAN7A, Dlrsctor June 22, 1989 Mr. Robert Hagen Albuquerque Field Office Office of Surface Mining Reclamation and Enforcement 625 Silver Avenue SW, Suite 310 Albuquerque, New Mexico 87102 RE: TDN #89-2-370-1, Orchard Valley Mine, C-81-038 Dear Mr. Hagen: We received the above Ten Day Notice on June 19, 1989. This TDN was issued by OSMRE as a result of a joint inspection conducted on June 7, 1989. During that inspection I requested that Orchard Valley Mine submit the necessary design documentation for the ditch in question in the form of a minor revision. Upon returning to the office and further evaluation of the Orchard Valley permit we have issued Notice of Violation #C-89-018 for failure to submit drainage designs. I would like to point out two errors contained in the TDN documentation that we received. Item 29b of the Mine Site Evaluation Inspection Report indicates that 6 partial inspections have been conducted at the site to date, when in fact 8 partial inspections have been conducted. Partial inspections have been conducted on the following dates: 7/13/88, 9/22/88, 11/1/88, 12/6/88, 1/25/89, 3/2/89, 4/13/89, and 4/28/89. Item 3b should be amended to reflect the fact that the inspection frequency has been met. Item 5 of the MEIR Supplement indicates that the last State Complete Inspection was conducted 130 days previous on 1/27/89. Complete inspections have been conducted at Orchard Valley Mine on the following dates: 8/17/88, 10/14/88, 3/22/89, 5/10/89, and 6/7/89.
