This letter informed the Department <br />of Health that noncompliance discharge started about May 7, 1986 and estimated <br />the discharge would be back in compliance by May 23, 1986. Compliance discharge <br />was actually achieved and maintained by May 16, 1986. <br />Section 5.03.2a of the Regulations of the Colorado Mined Land Reclamation Board <br />for Coal Mining states in part: <br />When an authorized representative of the Division conducts any inspection <br />and determines that any condition or practice subject to the Act, or any <br />violation of the Act, these Rules, or any permit ... then such authorized <br />representative shall issue a Notice of Violation to the operator ... . <br />Snowmass submits the Division did not conduct an inspection and therefore cannot <br />issue a Notice of Violation.
