Box 791 <br />Boulder, CO 80306 <br />Re: Status of the Revision, Varra Companies, Inc., Jenkins Site, <br />Technical Revision TR-001, Permit No. M-77-393 <br />Dear Mr. de Raismes: <br />The Division of Minerals and Geology has reviewed your letter dated April <br />21, 1995 regarding the above referenced gravel pit. Plea:;e be assured <br />that the concerns expressed in your letter are being given careful <br />consideration as they relate to reclamation of the site under the terms <br />of the approved reclamation permit and the Colorado Mined Land Reclamation <br />Act. On April 28th, the Division conducted its third inspection of the <br />Jenkins Site this year, in part to field verify certain reclamation <br />elements as they relate to the City of Boulder's concerns. A critical <br />component of the field inspection was to allow Division Senior <br />Environmental Protection Specialist, Carl Mount, to view the site and make <br />a final determination of the Division's position on whether the Varra <br />Companies April 5, 1995 submittal is a technical revision or an amendment. <br />As a result of Carl Mount's review, the Division's position that the Varra <br />Companies submittal is a technical revision remains unchanged. This <br />position is predicated on the basis that the revision is essentially a <br />clarification of the actual topsoil situation at the site available for <br />this reclamation project, as well as an improvement in the revegetation <br />plan. None of the elements in the revision meet the definition of a <br />"significant change" that would trigger an amendment. The following <br />clarifications and viewpoints are provided to update you on the status of <br />the permit as it relates to the concerns iterated in your letter. <br />1. It is stated in your letter dated April 21, 1995, that: the City of <br />Boulder has yet to receive any response to a letter dated January <br />25, 1995 concerning Jenkins Pit reclamation. The Jan>lary 25, 1995 <br />letter, sent to the Division from James S. Schmidt, City of Boulder <br />Open Space Property Agent, requested that the Division) inspect the <br />site and send Mr. Schmidt a copy of the inspection report. The site <br />was inspected on February 21, 1995, and the inspection report and a <br />reclamation cost evaluation were finalized by February 27, 1995. <br />
