Un January 7th 1983 , the pined Land Reclamation Board of <br />the Colorado Department of tlatural rte sources (the "State") granted to <br />Chinmey Rock Coal address 102 S. Teion St. <br />Suite 800. Colorado $prings_ CnlnraAn AR9(1't ("Permittee") permit number <br />C-81-023 (the "Pe rnrit") pursuant to which Permittee has been conducting a <br />mining and reclamation operation in the County of Arrl~uleta State of <br />Colorado. <br />B. Permittee wishes to assign the permit to Kaiser Steel Corncration <br />address 9400 Cherry Avenue Fontana. California ' <br />92335 as Successor Operator ("Successor") <br />and successor wishes o ecome uccessor ennittee under the permit. <br />v. Successor understands that the reclamation plan (the "Plan") <br />required Dy the permit and oy applicable State laws and regulations has not <br />been completed and is willing to assume full responsioility for the completion <br />of the Plan. <br />I I. <br />AGREEihENTS <br />Permittee and Successor nereoy agree, for their own oenefit and for the <br />oenefit of the State, such agreements to be effective ipso facto upon the <br />approval oy the State of the transfer of the Permit from Permittee to <br />Successor, as follows: <br />1. Successor has inspected the mining and reclamation operations to its <br />entire satisfaction and is fully aware of the condition thereof. Successor <br />understands and accepts all of the conditions of the Permit. <br />Z. Successor will Complete the reclamation plan, and he reoy assumes <br />liaoility for completing such plan as to all areas heretofore disturbed, as <br />well as to all areas hereafter disturbed.
