Long <br />Director <br />Colorado Division of Minerals and Geology <br />1313 Sherman Street Room 215 <br />Denver, Colorado 80203 <br />Re: Battle Mountain Resources <br />San Luis Project - Permit Number M-88-112 <br />Dear Mr. Long: <br />The purpose of this letter is to document recent discussions we <br />have had with your office in which we have notified',you that <br />Battle Mountain has identified certain monitoring datalwhich is <br />missing from its files and to discuss the circ mstances <br />surrounding our discovery of the missing data and the steps <br />Battle Mountain has taken to respond to the situations As you <br />know, Battle Mountain has established a corporate envi3~onmental <br />policy and administrative oversight mechanism des gned to <br />ensure the maintenance of environmental compliance t all of <br />its facilities. In addition to standard employee eporting <br />protocols regarding environmental compliance activi ies, our <br />policy allows for periodic audits by managemen and/or <br />independent third party consultants. In the course o such an <br />internal file audit conducted by Battle Fountain management <br />personnel during March, a potential discrepancy 3.n our <br />monitoring records for the San Luis facility was id ntified. <br />Upon noting the discrepancy, we contacted the corr sponding <br />laboratories and conducted an unannounced on-site file audit on <br />April 4. These reviews resulted in the conclusion th t Battle <br />Mountain files did not include the data from the req fired bi- <br />weekly sampling of the monitoring points specified in TR-6 for <br />the period between December 1993 and June 1994 and ~ata from <br />the required quarterly monitoring as required by TR- for the <br />first and second quarters of 1994. <br />Battle Mountain management had received monthly employee <br />performance reports during the period reflecting that the <br />sampling had been completed.
