Long <br />Division Director <br />RE: Third Party Monitoring; Missed Sampling Event; Battle Mountain <br />Resources Inc.; San Luis Project; Permit No. M-88-1 2 <br />Dear Alana: <br />The Division acknowledges that RCG/HBI failed to conduct third party <br />monitoring at the San Luis facility during the week of ly 26-30 as <br />specified by the conditions set forth in the contract be ween RCG/HBI <br />and BMRI and the Memorandum of Understanding between MRI and the <br />Division of Minerals and Geology. We acknowledge further that RCG/HBI <br />has not provided an itemized invoice adequate for approva for payment <br />by the Division. Both items are being addressed by RCG/ BI. <br />The Division is of the opinion that situations like t is might be <br />avoided if communication between RCG/HBI and BMRI were of directed <br />through the Division. If you feel this is inappropria a under the <br />contract and the MOU, please let me know. In my absense (August 5 - <br />29) you should discuss the matter with Jim Pendleton. Th~ Division is <br />evaluating how to address the situation.
