Long <br /> Division Dbeclor <br />Re: Request for Release of Undisturbed Lands, San Luis Project, M-88-112 <br />Dear Mr. Lyle: <br />The Division received BMRI's request for release of reclamation responsibility of the <br />undisdurbed Earth Science, Inc. (ESI) lands in the northeast permit area and consisting of <br />approximately 400 acres. Since this property was not part of the approved affected lands, BMRI <br />would not be responsible for any reclamation since the lands should not have been disturbed by <br />any mining activity. Also, since mining disturbances were not allowed on this part of the permit <br />azea, the financial warranty did not include any money to reclaim the land and, therefore, the <br />Division will not adjust the financial warranty requirement. As noted in the request, BMRI is not <br />asking for a release of any of the financial warranty but, rather, just a re-adjustment of the permit <br />boundary. <br />The request for release of the undisturbed ESI lands was received and deemed co-nplete on <br />October 25, 1999. BMRI must comply with Rule 4.16.1(2) ,Rule 4.16.4 and, sinL:e pazagraph <br />of Rule 4.16.4 states that the operator/permittee shall follow the Public Notice prt3cedures as <br />provided for in Subsection 7.2.10, BMRI must comply with Rule 7.2.10. <br />Pursuant to Rule 7.2.11, [he Division shall inspect the undisturbed ESI lands within sixty (60) <br />days after receiving the request. <br />If you have any questions, please give me a call. <br />'ncerely, ~~ <br />James Dillie <br />Environmental Protection Specialist <br />cc: H.
