LnnF <br />Dmvon Uireaor <br />Please find enclosed, extension of the abatement deadline for excavation and disposal of <br />the haul road sediment deposited in 006 Gulch (culvert ME-5) and in Dry Creek (culvert <br />G-2). The 5/5/95 deadline for these abatement steps is extended to 5/19/95 due to <br />muddy field conditions resulting from inclement weather. Also, please find enclosed, an <br />extension for the submittal date for the TR. The 4/30/95 deadline for submittal of the <br />TR is extended to 5/19/95. The TR requirement has been modified, I have also <br />enclosed this third modification to NOV C-95-007. <br />The purpose of this third modification to NOV C-95-007 is to revise the TR required for <br />abatement. Prior to this modification, the TR was to address each of the five locations <br />where erosion and/or siltation was cited by this NOV. After reviewing your letter dated <br />4/28/95, the Division has determined that the TR need only address the situations cited <br />at culverts G-2 and ME-5. An explanation for our determination follows. <br />1. The erosion repair plans submitted in your 4/28/95 letter for ditches HRD-Al, <br />TAHRD-7, and culvert TAHRC-1 will abate the violation cited at those locations <br />and the plan does not change existing permit conditions, as such the plans can be <br />implemented immediately. <br />2. Hydrologic calculations for culvert G-2 show the peak discharge from the 10-year, <br />24-hour event, at culvert G-2, to be 94.8 cfs. Culvert G-2 outlet velocity for 94.8 <br />cfs is 10 fps. Plans for such flows are handled appropriately through the revision <br />process, as such a TR addressing the situation at culvert G-2 is required. <br />III1l11U1111111111 <br />STATE OF COLORADO <br />
