Box 388 <br />Fairplay, Colorado 80440 <br />RE: Formal Public Hearing, td & .4 Mining Company, <br />The Snowstorm Placer, Permit No, to-84-125 <br />Dear Ms. Comer-Baker: <br />On November 15, 1990, the Colorado Mined Land Reclamation Board conditionally <br />approved the amendment application for the Snowstorm Placer that was found <br />complete on June 14, 1990 (copy of approval letter enclosed). Condition <br />Number One of the Board's approval required that the financial warranty <br />of this operation be raised from the existing E11,022.00 to X60,000.00, and <br />that this increase in financial warranty be submitted to the offices of the <br />Colorado Mined Land Reclamation Division by December 17, 1990. <br />To date, the Division has not received this financial warranty increase. <br />Therefore, we have reason to believe a violation exists to Permit No, M-84-125 <br />and Statute 34-31-124 of the Colorado Mined Land Reclamation Act, entitled <br />"Failure to comply with the conditions of an order, permit, notice of intent <br />or regulation," A Formal Public Hearing has been scheduled to be held during <br />the January 23 24, 1990 Board meeting for consideration of possible <br />violation. The hearing will be held in Room 318 of 1313 Sherman Steet, <br />Denver, Colorado, beginning at 8:30 a. m. or as soon thereafter as the matter <br />can be considered and you have the opportunity to be represented and heard. <br /> <br />
