Disturbance consists of partial topsoil stripping and equipment operation <br />on the affected area. Duration is from 1/30/96 inspection until March 27, a total of 57 <br />days. <br />SERIOUSNESS <br />Offsite damage: moderate offsite damage to 1.8 acre. <br />HISTORY OF VIOLATIONS IN PAST TWELVE MONTHS <br />There are no outstanding corrective actions or unpaid civil penalties. <br />STAFF RECOMMENDATION <br />Violation{s): The Division recommends that the operator be found in violation <br />for offsite damage, pursuant to CRS 34-32.5-116(4)(1). <br />CEASE AND DESIST ORDER <br />No cease and desist order is necessary because the operator has successfully <br />brought the offsite disturbance into the permit area through a land exchange. <br />Corrective Action(s): The operator initiated and completed a land exchange, by <br />which undisturbed land was released from the permit, and all offsite disturbance <br />was subsequently brought into the permit area.
