Box 1523 <br />Longmont, CO 80502 <br />RE: Gold Hill Mill, Permit No. M-1994-117 <br />Deaz Mr. Steen: <br />On August 14, 2002, the Division of Minerals and Geology inspected the Gold Hill Mill and found the <br />following: <br />DIVISION OF <br />MINERALS <br />GEOLOGY <br />RECLAMATION <br />MINING•SAFETY <br />Bill Owens <br />Governor <br />Greg E Watcher <br />Executive Director <br />Ronald W. Cattany <br />Acting Division Director <br />The operator has failed to submit the 2001 annual water monitoring report to the Division of Minerals and <br />Geology. <br />We believe this is in violation of: C.R.S. 34-32-116(1) of the Colorado Mined Land Reclamation Act for <br />failure to perform such reclamation as is prescribed by the reclamation plan. Specifically, for failure to <br />submit the annual groundwater monitoring report for 2001. <br />Therefore, we have reason to believe that a violation exists to Perntit Number M-1994-117 and to the Law, <br />and have scheduled this matter before the Mined Land Reclamation Boazd. <br />A Formal Public Hearing will be held during the November 20, 2002 Boazd meeting for consideration of <br />possible violation. The November Boazd meeting will be held on Wednesday, November 20, 2002 at 10:00 <br />a.m. at the National Mining Hall of Fame and Museum-Conference Center, 120 W. 9th Street, Leadville, <br />Colorado, 80461. At that hearing you will have the opportunity to be represented and heazd. It will be <br />reiterated that there is reason to believe that you aze in violation of the provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a Cease and Desist Order, assess a Civil Penalty in <br />the amount of $50 to $200 for each day of violation, and/or order the permit be suspended, modified, or <br />revoked. In addition, it may se[ [he matter for forfeiture of the $46,215.00 financial warranty at a subsequent <br />hearing. If you have evidence indicating that the possible violations noted above do not exist or have been <br />corrected, please provide it to us as soon as possible or bring it to the hearing.
