On August 14, 2002, the Division of Minerals and Geology inspected the Gold Hill Mill and found the
following:

The operator has failed to submit the 2001 annual water monitoring report to the Division of Minerals and
Geology.
We believe this is in violation of: C.R.S. 34-32-116(1) of the Colorado Mined Land Reclamation Act for
failure to perform such reclamation as is prescribed by the reclamation plan. Specifically, for failure to
submit the annual groundwater monitoring report for 2001.
Therefore, we have reason to believe that a violation exists to Perntit Number M-1994-117 and to the Law,
and have scheduled this matter before the Mined Land Reclamation Boazd.
A Formal Public Hearing will be held during the November 20, 2002 Boazd meeting for consideration of
possible violation. The November Boazd meeting will be held on Wednesday, November 20, 2002 at 10:00
a.m. at the National Mining Hall of Fame and Museum-Conference Center, 120 W. 9th Street, Leadville,
Colorado, 80461. At that hearing you will have the opportunity to be represented and heazd. It will be
reiterated that there is reason to believe that you aze in violation of the provisions noted above.
If the Board finds a violation at this hearing, it may issue a Cease and Desist Order, assess a Civil Penalty in
the amount of $50 to $200 for each day of violation, and/or order the permit be suspended, modified, or
revoked. In addition, it may se[ [he matter for forfeiture of the $46,215.00 financial warranty at a subsequent
hearing. If you have evidence indicating that the possible violations noted above do not exist or have been
corrected, please provide it to us as soon as possible or bring it to the hearing. If you have any questions,
