Lochhead <br />Executive Director <br />MlchaelB Long <br />Division Dveaor <br />On September 22, 1994 the Division wrote notice of violation C-81- <br />020 to the Munger Canyon Mine (C-81-020) for failure to design and <br />construct sediment control measures to prevent additional <br />contributions of sediment to runoff outside the permit area <br />(Section 4.05.5(1)(a). This violation was written at the end of <br />a complete inspection at the Munger Mine. <br />Two areas are incorporated under this notice of violation; the <br />facility area and the fan area. The facility area drainage drains <br />into SAE #1. There is one area, roughly 20' by 100', that is not <br />diverted to SAE #1. The drainage from this area was routed into <br />the road ditches, and eventually discharged off site. The other <br />area incorporated under this NOV is the mine fan. The fan had a <br />berm and silt fence to contain sediment, but was not designed and <br />approved by the Division. No off site damage was noted. <br />Prior to close of the inspection, the operator presented plans to <br />divert the facility area to SAE #1 and to provide a design and <br />description of the fan area (now called SAE #5). Designs and maps <br />were required to be submitted to the Division on August 30, 1994. <br />The plans were received by DMG on August 26, 1994 and the designs <br />were implemented on October 3, 1994 (DMG required implementation by <br />October 10, 1994). The operator was diligent in submitting the <br />required MR and implementing the designs. <br />c:\munger\941007 <br />
