Long,
Division Director
During the public hearing convened by the Colorado Mined Land declamation
Board on April 23rd to consider the notice of violation issued to B the
Mountain Gold, the following abatement requirements were placed upo the
operator. I believe you will find them to embody your technical su gestions.
The Board upheld the NOV, found Battle Mountain Gold in "Willf 1"
violation of our statute and regulations, and levied a 5168,900 pen ity,
payable within 30 days of Board order issuance. The Board order wi 1 be
issued at the May 27/28 meeting of the Board. Further, the Board in tructed
the Division to reissue the violation, if it saw fit, because "the iolation
continues until it is abated". Finally, the Board conveyed upon th Division
the power to issue a Cease and Disist order if any cyanide contamin tion was
detected outside the tailings area containment.
We appreciate your technical suggestions and comments.
Sincerely your
,. > ~~
~-
~-~ 1
~James.A.
