.:~ .. , , iii ~iniiiiii-iiiii • • MEMORANDUM OF UNDERSTANDING BETWEEN THE DIVISION OF MINERALS & GEOLOGY, DEPARTMENT OF NATURAL RESOURCES AND THE WATER QUALITY CONTROL DIVISION, COLORADO DEPARTMENT OF HEALTH RELATIVE TO WATER QUALITY MANAGEMENT AT COAL MINES PURPOSE The purpose of this Memorandum of Understanding (HDII) is to deflne the respective responsibilities of the Division of Minerals and Geology (DNG) of the Colorado Department of Natural Resources and the Water Quality Control Divislon (WQCD) of the Colorado Department of Health regarding coal mining activities as they impact the hydrologic balance. The purpose of this HOB also is to: 1. Ensure that appropriate corrective actions are applied eo as to minimize the period of non-compliant discharge; 2. Provide protection of the State's water resources by ensuring that non- compliant dischargers are appropriately cited in a timely manner and do not receive an economic benefit over other facilities as a result of non- compliance; 3. Coordinate enforcement actions eo ae to minimize dual enforcement to the extent possible, while maintaining the integrity of the programs implemented by each Division; 4. Foster enhanced communications and working relationships between the two Divisions. UNDERSTANDING BETWEEN THE PARTIES This HOU is entered into by the DMG of the Colorado Department of Natural Resources and the WQCD of the Colorado Department of Health, (the parties) and may be modified 6y written concurrence of both parties. This HOU replaces the previous HOU which was entered by the parties on January 21, 1985. Nothing iq this HOU shall be construed to preempt or alter the statutory or regulatory reaponeibilitiea and authorities of either party.
