Long <br /> Dinsmn D'vexlar <br />RE: Beach Hill Quarries, Permit No. M-81-277 <br />Dear Mr. Loukonen: <br />On March 1, 1999 the Division of Minerals and Geology conducted an inspection of [he Beach Hill Quarries, Permit No. <br />M-81-277 and found the following: <br />The eigh[ (8) quarries within the 9.9-acre permit area were surveyed using the Trimble GeoEzplorer li Global Positioning <br />System (GPS). The collected data indicate that the Beach Hill Quarries are collectively 13.7 acres in size, roughly 3.3 acres <br />ou[side of the present permit boundaries of Permit No. Nt-81-277. Based on the data collected, [he operator failed to first <br />obtain a reclamation permit prior to engaging in a new operation, a possible violation of C.R.S. 34-32.5-1090) or the <br />operator failed to protect areas ou[side of the affected land from slides or damage during [he mining and reclamation <br />operations, a possible violation of C.R.S 34-32.5-116(4)(1). ~Ve believe this is in violation of the Colorado Land <br />Reclamation Act for the Extraction of Construction Materials, Rule 3.1.5(3) of the Construction Materia{ Rules and <br />Regula[ions and Permi[ M-8I-277. The Division will scheduled [his mater before the Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the April 28-29, 1999 Board meetirig for consideration of possible violation. <br />The hearing will be held in Room 318 of 1313 Sherman S[reet, Denver, Colorado, beginning at 9:00 a. m. or as soon <br />thereafter as the mater can be considered. At tha[ hearing you will have the opportunity to be represented and heard. It <br />will be reiterated that there is reason [o believe that you are in violation of the provisions noted above. <br />[f the Boazd finds a violation at this hearing, it may issue a Cease and Desis[ Order, assess a Civil Penalry in the amount <br />of $1000 to $5000 (operating without a permi[) or 5100 to $1000 (affecting the area ou[side the permit area) for each day <br />of violation, and/or order [he permit be suspended, modified, or revoked.
