Banta, <br />Division Director <br />Mr. James Lunan <br />Peabody Coal Company <br />1300 South Yale <br />Flagstaff, Arizona 86001 <br />RE: Erosion at Inlet of Sediment Pond 005, Nucla Mine, Permit C-81-008 <br />Dear Mr. Lunan: <br />Inlet erosion just below the riprap for the outlet of culvert C-21 and the <br />bottom of sediment pond 005 was noted during the complete inspection of August <br />16, 1990. The permit was subsequently reviewed to determine compliance with <br />Rule 4.05.9(4). The Division has founa that although riprap has been <br />installed according to the approved plan t'or Culvert C-21 (See Tab 13 <br />Attachment B-E and Exhibits 13-15 and 13-15A), it is apparent that riprap <br />installation has not completely protected the pond slopes from inlet erosion. <br />Therefore in accordance with Rule 2.08.x(3) the Division orders that this <br />condition be rectified via a minor revision to the permit. This minor <br />revision should address how Peabody will protect the inlet channel to sediment <br />pond 005 and any other sediment pond on site that shows or has the potential <br />of showing similar erosion. Channels should be protected down to a stable <br />elevation. In this case, we believe the stable elevation exists at the <br />average water level of the pond. Please submit this revision no later than <br />September 28, 1990.
