I received a fax letter from Jim Hunter <br />which outlines this fact. <br />As you are aware, I have discussed all NPDES reports, sediment pond <br />inspections and other data which are required in the public file. <br />I can assure you that the material was sent to the public file <br />before the deadline dates. For this reason, I would like to pursue <br />the vacation of the violation. <br />However, this entire incident raises the question of the <br />reliability of Hovi Sales as a secure location for the storage of <br />the files. Hovi Sales is basically an auto parts business that is <br />not particularly concerned with the Apex #2 files. It is <br />questionable that data for the public file sent by mail is <br />guaranteed to be put into the file. Therefore, I propose that the <br />public file be moved to the County Building in Steamboat Springs, <br />where other mines in the area have their public files located. <br />Although this is also no guarantee of reliability, it is definitely <br />a better location. Also, I propose that Sunland will keep a <br />separate three-ring binder with all sediment pond inspection <br />reports, NPDES reports, water monitoring data and any other ongoing <br />inspections, etc. which may be needed.
