Snell & <br />Wilmer, LLP, and provides a Status Report as follows: <br />1. On June 14, 2001, the Colorado Mined Land Reclamation Board ("Board") issued <br />its Findings of Fact, Conclusions of Law and Order in the Matter of Powderhor Coal Company, <br />File No. C-1981-041, Notice of Violation Numbers CV-2000-010 and CV-2001-005, Request for <br />Hearing on Notices of Violation ("NOV Order"). In the NOV Order, the Board upheld the <br />Division of Minerals and Geology's ("Division") issuance of NOV Nos. CV-2000-010 and CV- <br />2001-005 ("NOVs") [o Powderhor Coal Company ("Powderhom"). <br />2. Due to the statute of limitations, on or about July 16, 2001, Powderhor was <br />obligated to file its complaint in order to preserve its appeal rights for judicial review of the <br />Board's NOV Order. <br />3.
