,~; ~,~
November 15, 2005
Mr. Tom Schreiner
Division of Minerals and Geology
1313 Sherman Street, Room 215
Denver, Colorado 80203
RE: SW-TKO Joint Venture, LLC, Application No. M-20 4078
Lupton Lakes Resource; Technical Revision 2
Dear Mr. Schreiner:
~ TR~z
CIVIL RES~URCES,LLC
ENGINEERS & PLANNERS
- ,. • ,
,~
~~'J i is 2005

v
Following is our response to your Adequacy Review dated November 10, 2005.
1. The operator commits to providing follow up as-built certification from a qualified, registered
professional engineer that the stabilization measures installed at the point of offsite discharge have
been constructed in accordance with the approved plans.
2. Please note that during our meeting on November 8, 2005 with Carl Mount, Bruce Humphries and
yourself, the Division agreed that the operator could expose groundwater in phase 1 priar to
collecting five quarters of baseline water quality data . However, the operator cannot expose
groundwater in any other phases prior to collection of this data.
3. The map showing the locations of the recharge pond and the schematic showing the height of water
level in the recharge pond in relation to the groundwater surface and Landrus well are attached to
the Groundwater Sampling and Analysis Plan (SAP). The schedule for when each recharge pond
will become operational is in Section 3.0 Proposed Project of the SAP.
4. The maximum infiltration rate from the recharge pond is 2,000 gallons per minute at each recharge
site.
5. The SAP includes a monitoring plan chat addresses baseline water quality monitoring for the
parameters you requested, a discussion of how the baseline concentration for each analyze will be
determined and exceedance verification measures.
6. Notification procedures to be followed in the event of an exceedance will be consistent with the
requirements of Rule 3.1.13.
7. A copy of the certified mail return receipts to the Landrus' is attached.
8. The operator will submit a revised plan for ongoing monitoring no later than 60 days prior to the end
of the initial two year monitoring. It is our understanding that the revised plan will require Division
review and approval via the technical revision process.
451 ^nK BTR EET, Su1TE 209 ~ P.O.
