As of March 7,
1994, Slurco has requested that we consolidate the Notices of
Violation, as an alternative to Board consideration. The request
has merit, and I recommend the following actions:
1) Modify Notice of Violation C-94-024, to cite a general
"failure to meet certain impoundment standards", and to
specifically include "failure to provide evidence that
the impoundments were inspected by, or under the
direction of a qualified professional engineer".
The original C-94-024 was written for failure to meet
certain impoundment performance standards, specifically
rules 4.05.9(1)(e) and (f), and 4.05.9(8). This
modification would be consistent, and would add rule
4.05.9(13).
2) Vacate Notice of Violation C-94-027 which separately
addresses the missing P.S. certifications on certain
impoundment inspection reports. The contents of this
violation would be appropriately addressed in the
modified C-94-024.
3) Modify Notice of violation C-94-026 to include a general
citation such as "failure to maintain records in a proper
manner", then add a specific citation which references
the late 1993 Annual Hydrology Report submittal of
January 6, 1996. Notice of Violation C-94-026 currently
references a failure to have certain records available
for public review at the Jackson County Courthouse. Both
situations involve maintenance of administrative records;
and neither situation resulted in any negative consequence.
r
