Lang <br />Division DirKlor <br />The Division received the Ten Day Notice Number X-93-020-370-005 TV 3 on December 9, <br />1993. We wish to take this opportunity to respond to the three issues in the Ten Day Notice. <br />As the TDN speed violations by Basin Resources, Inc. to exist only with the property <br />boundaries of Mr. Jim Tatum, our responses reflect our review of that particular area. <br />Failure to Comply with Rules 2.05.6(6) and 4.20. <br />The fast issues concerned Basin Resources, Inc.'s alleged failure to pmpeLiy conduct a <br />subsidence survey, subsidence monitoring and a subsidence control plan, as well as an <br />alleged failure to submit a complete subsidence inventory of structures, with regard to <br />property owned by Mr. Jim Tatum of Houston, Texas. <br />Aocor+ding to Rule 2.05.6(6)(a}, applications for underground mining activities shall include <br />an inventory of all structures and renewable msource lands which exist within the proposed <br />permit and adjacent area. The permit includes such an inventory. A photocopy of a portion <br />of a permit map depicting Mr. Tatum's property is attached. Mr. Tatum's property lies <br />principally within the Purgatoire River Valley Alluvial Valley Floor (AVF) and outside of <br />the AVF. The Division issued the Golden Fagle Mine permit with a requirement that mining <br />beneath the AVF would be limited to room and pillar operations, to prevent subsidence from <br />occurring. Room and pillar operations within the AVF were further restricted to no more <br />than 50~ extraction, to further ensure subsidence would not occur. <br />
