Burgmaier <br />Division of Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />RE: Written Information about Notice of Violation No. CV-98-005, <br />NOV received 4/16/98 by Energy Fuels Coal, Inc. <br />Southfield Mine, Permit No. C-81-014 <br />Dear Susan: <br />MAY 19 1998 <br />Division of Minerals & Geology <br />Notice of Violation No. CV-98-005 was written for alleged failure to construct and maintain <br />the light use road providing access to the South Fan Installation to control or prevent erosion, <br />and failure to ensure that the light use road (above) will not cause additional contributions of <br />suspended solids to run-0ff outside the permit area. <br />The abatement steps include (in summary) development of a plan, and submittal of a revision, <br />for stabilization of the road ditches and road surface. In addition, EFCI is to implement the <br />approved plan following approval by the Division. <br />Although the regulatory time period to provide information about the violation has elapsed, <br />EFCI requests that this letter and its attachment be placed in the file for Notice of Violation <br />No. CV-98-005. <br />EFCI is providing the following information relevant fo the alleged violation: <br />EFCI commenced use of the road to the South fan, as a permitted road, in October 1993 <br />upon approval of Technical Revision No. 16. Actual use of the road and installation of the <br />fan facility occurred in February 1992. <br />The road subject to this violation was constructed in the 1930's. The road surface was well <br />constructed, and both the surface and road cuts were stable in 1992. When EFCI began use of <br />the road, we made no changes to the road or its drainage in order to minimize disturbance. <br />This approach is evident at the fan installation where we utilized the existing, abandoned <br />Monarch Mine fan portal for constructing the new fan. As with use of the road, new <br />disturbance was kept at a minimum. Since the road will remain following reclamation, EFCI <br />did not intend to make changes to the road. <br />
