Interoffice <br />MEMORANDUM <br />to: Mike Long ---1 <br />from: Kent Gorham tia'a-D <br />subject: CV-2002-002, Lorencito Canyon Mine, Extension beyond 90 days <br />date: May 17, 2002 <br />In accordance with Rule 5.03.2(e), I request that the abatement period for NOV CV-2002-002 extend <br />beyond 90 days based upon the following information. <br />NOV CV-2002-002 was issued on February 13, 2002 for failure to notify all residents within one-half mile <br />of the permit azea of the right to request apre-blast survey on the home and/or structure(s). The abatement <br />requirement is to notify all residents or owners of structures within one-half mile of the permit boundary <br />and provide to the Division signature evidence and a map demonstrating all parties were properly notified. <br />The original abatement deadline was set as February 22, 2002. The chronology is as follows; <br />February 13, 2002 Issued <br />February 21, 2002 FAX progress update, still researching absentee ownership <br />February 21, 2002 Extended to Mazch 29, 2002 <br />February 22, 2002 Original abatement <br />March 8, 2002 FAX progress update <br />March 26, 2002 FAX progress update, 13 certified receipts in hand, 9 to go <br />March 27, 2002 Extended to April 18, 2002 <br />April 11, 2002 FAX progress update, five owners still no response <br />April 17, 2002 Extended to May 13, 2002 <br />May 13, 2002 Two owners remain outstanding, one still no contact address <br />On May 14, 2002 the mine was able to obtain a phone number for one of the two remaining owners of a <br />rental property. The individual indicated that they did receive the certified letter. On May 15, 2002 <br />Lorencito Coal Company (LCC) received the certified receipt and provided a copy to the Division. <br />Therefore, at this time, one owner of a small trailer remains outstanding. The Postal Service, neighbors, <br />and local residents have no forwazding address or information for him. The county assessor's office lists <br />his contact address as the trailer address on Highway 12 and has no phone number for this individual. The <br />trailer is uninhabited at this time based on personal visits by mine personnel. LCC holds the returned pre- <br />blast notice letter following three attempts by the post office to deliver. <br />Based on the fact that a signature from one owner of a trailer remains outstanding, I recommend that we <br />grant the mine an additional 30 days to abate this NOV, effective May 13, 2002. <br />CC: Dan Hernandez <br />David Berry <br />
