Cottony <br />Paonia, Colorado 81428 Division Director <br /> Natural Resource Trustee <br />RE: Bowie No. 2 Mine, Permit No. C-96-083, Bowie Resources LLC <br />Technical Revision No. 45, New Coal Refuse Pile, Second Adequacy Review <br />Dear Mr. Bear: <br />The Colorado Division of Reclamation, Mining and Safety (Division) has finished its adequacy review of <br />Bowie Resources LLC's (BRL) recent submittal dated January 3, 2007 far Technical Revision No. 45 <br />(TR-45). The submittal was in response to the Division's first adequacy review letter dated December 4, <br />2006. <br />The Bureau of Reclamation has indicated to the Division that they need additional time for review of TR- <br />45 and that they anticipate having adequacy review questions and comments. When the Division receives <br />their adequacy review letter, we will forward it to BRL. <br />The following are the Division's questions and comments: <br />Section 2.05.3(3), Mine Facilities <br />Construction ofgob pile no. 3 would bury the dirt road that runs past the orchard. Who is the <br />owner of this dirt road? <br />The Division has no further concerns. In the January 3, 2007 submittal, BRL responded that they <br />own the road. <br />2. Map 15 does not show any access roads leading to the proposed new topsoil stockpile and <br />coverfill pile. How will these two stockpile areas be accessed'? <br />In the submittal dated January 3, 2007, BRL revised Map 15-3 to show a new access road. Pages <br />Exh-8-180vi, Exh-8-31 and 2.05-25 were also revised as a consequence of this proposed road. <br />However, comparison with the approved Map 15-3 shows that the proposed road would cut <br />through the middle of the present topsoil stockpile. Please explain or propose another location for <br />the access road. <br />Please provide written confirmation that the Colorado Department ofTransporfation (CDOTJ <br />approves of the construction of a conveyor system over o[d State Highway 133. <br />BRL is working with CDOT to obtain the permit.
