The Board appeared to feel that the County had not
really availed itself of the opportunity to demonstrate, by means
of its survey and illustration of the permit area, that all mining
related disturbance might actually be within the approved permit
area.
Any. corrective action ordered by the Board, should it have heard
and found a violation for damage outside the permit area at the
February 27, 1997 meeting, would probably have included requiring
the County to submit an amendment or conversion application which
would include all land disturbed outside of the current permit
area. As a result, the Division is prepared to withdraw the
violation from further consideration by the Board if the County
will diligently pursue and secure approval of its recently
submitted conversion application prior to the June 25-26, 1997
hearing. Approval of the conversion application would bring the
Airport Pit into compliance, which is the Divison's primary
concern, and the withdrawl would eliminate any need by the County
to resu prey and mark the current permit area boundaries.
Should you have any questions on the above, please contact me.
Sincerely,
James C. Stevens /
Sr. Specialist
97N013
