Per Rule 5.04.3(5) (c) the Division is <br />required to issue a Notice of Proposed Civil Penalty within 120 days of the issuance of the <br />NOV if the penalty has not been paid. Enclosed is the Notice and Order to Pay Fixed <br />Penalty for this violation. This violation was issued to the Marr Strip mine on June 25, 1992 <br />for problems associated with the sediment control system.
