Lochhead <br />Executive Director <br />Michael B Long <br />Division Director <br />The Division received your application to convert the former oil tank containment area into <br />a small area exemption (TR-12) on October 24, 1994. The Division has found your <br />submittal incomplete at this time for the following reasons: <br />1. The Division did not receive a copy of your proposed publication as per Rules <br />2.08.4(5)(b)(i) and 2.07.3(2). <br />Rule 2.08.4(5)(b)(i) states, <br />Technical Revision. An applicant for a technical revision shall place an advertisement <br />in a local newspaper pursuant to the requirements of 2.07.3(2), except that the <br />publication need only be once.... <br />Rule 2.07.3(2) states, <br />At the time of submission of an application for a permit, or for renewal or revision of <br />an existing permit, the applicant s/tall submit to t{te Division the proposed notice of <br />publication of the ownership, precise location, and boundaries of the land to 6e <br />affected by the proposed surface coal mining operation.... <br />2. The Division did not receive sufficient information to determine weather the <br />proposed revision will comply with the Act and Rules as required by Rule <br />2.08.4(4)(d). SAE demonstrations must be site specific, demonstrations submitted <br />previously for other SAE's do not satisfy the requirements of Rule 4.05.2(3). Please <br />submit SAE demonstrations for the specific area of concern. <br />
