Lang <br />Division Direcor <br />The Division completed a technical review of your amendment application. In order to meet <br />the minimum requirements of the "Act" and "Rules" the following items need to be addressed: <br />f 1) The south permit boundary distance is incorrect on all of the maps. You show <br />a distance of 1930 feet. However, at ]inch equals 300 feet scale, the distance <br />should be around 2205 feet. Please revise the maps and send one copy to the <br />/ Division. <br />1 2) You state that the mining depth will be about 7 feet (Exhibit D). During the <br />pre-operation inspection it appeared that the existing pit was being mined to <br />a depth somewhat greater than 7 feet. Please clarify your proposed mining <br />depth. <br />3) As observed during the pre-operation inspection there is an existing <br />disturbance (pre-law site) adjacent to the proposed west permit boundary. <br />Please provide a narrative explaining, as best you can, the history of the <br />disturbed area. In addition be aware that any re-disturbance of the site could <br />result in a possible violation. <br />1/ 4) In Exhibit E (Rule 3.1.11) you state there are no buildings within 200 feet of <br />the affected area but you did not address the structure (powerline) that will be <br />/ within 50 feet of the south permit boundary. <br />,/ 5) Pursuant to Rule 6.4.19(a) please provide a notarized agreement between Otero <br />County and the company having an interest in the powerline, that Otero <br />County is to provide compensation for any damage to the powerline. <br />;/6) Pursuant to Rule 6.4.7(3) &(4), you need to provide an estimate of the project <br />water requirements (dust control etc.) and the source of the water supply. <br /> <br />
