Barry, II I, <br />Director <br />January 18, 1982 <br />TO: Linda Pipo, Attorney Cenera 's fice <br />FROM: Jim Herron and Fred Banta <br />SUBJECT: Succession of Operator: GEX Colorado, Inc. - Powderhorn Coal Company <br />As discussed with you earlier, Powderhorn Coal Company, owned by western <br />Associated Coal and NZCOR, has purchased the Roadside and Cameo mines from <br />GEX Colorado, Inc. Western Associated Coal will be the controlling partner. <br />Western has made a request to replace the current surety secured by a deed of <br />trust with a corporate surety. It seems that Western needs to remove the first <br />Liens, held by the Division, on the facilities at the Roadside and Cameo mines. <br />Because we must make a number of findings for succession of operators which <br />are also required for permit approval, the Division would prefer to handle the <br />succession of operators as part of the permit approval process during the next <br />2-3 months. The problem we need you to research is whether Powderhorn Coal <br />Company can replace the current surety without a succession of operators, and <br />if the surety can be replaced, what language should be on the bonding form. <br />Fred and I will be out of the office until January 22, 1981 Lf you need to <br />contact either of us, please leave a message in the office.
