Box 276 <br />Elizabeth, Colorado 80107 <br />Re: Succession of Operator Miller-Berends Pit, File No. M-85-179 <br />Dear Mr. Hurst: <br />We are in receipt of your letter dated December 10, 1990 pertaining to the <br />amended operator name of the above referenced operation. A certificate from <br />the Secretary of State was enclosed with the name change to Elbert Sand & <br />Gravel Co. The Certificate of Amendment certifies that Elbert Sand & Gravel <br />Co. was formerly known as Miller-Berends Co. <br />I have reviewed the name change with our Assistant Attorney General. We both <br />agree that the only way to process the name change for the 14ined Land <br />Reclamation Division and Board is through the Succession of Operator process. <br />This process is appropriate as the company; which no longer legally exists, is <br />the permittee for the Miller-Berends Pit. It is necessary to transfer the <br />permit from the now defunct company to Elbert Sand & Gravel Co. <br />The Succession is also necessary to have a new Performance Warranty, executed <br />by the new permittee, on file.
