Crosby: <br />This correspondence is being submitted to ask for a modification of <br />NOV C-95-014. Also based on our phone conversation earlier today, <br />we are also requesting a two week extension of Step 1 of the <br />remedial action necessary to abate this violation. This action <br />required that the material be removed from the disturbed area and <br />revegetate according to the requirements in the permit. Because of <br />the recent precipitation the mine has received, we would like to <br />wait until the stockpiled topsoil and ground conditions have dried <br />out. Therefore, the new deadline would be June 9. <br />The reason we are asking for a modification to the NOV is that the <br />material that was pushed past our disturbance boundary is actually <br />topsoil. Please refer to the attached drawing by Roy Karo, <br />Reclamation Supervisor, for the steps that occurred prior to <br />issuance of the NOV. The area in question is located on the <br />highwall side of Auger Area E. The top sketch shows the area prior <br />to initiating reclamation work in July 1994. The middle diagram <br />shows that we needed to start the final postmine slope directly at <br />the edge of our disturbance boundary. Therefore, prior to starting <br />the final postmine slope, additional topsoil was removed by dozing <br />and stockpi7.ing it to the south, past the disturbance boundary. <br />This is depicted in the bottom sketch. we did salvage topsoil prior <br />to the final backfilling and grading, so regulation 4.06.1(1) <br />should not be part of this violation. <br />Finally, under the steps necessary to abate the violation Step 1 <br />should be revised. Removing the material... should read Replace the <br />topsoil... permit. As part of the abatement process silt fence was <br />installed on Friday, May 19 to contain any sediment from leaving <br />the area. A minor revision to the Seneca II permit will be <br />submitted next week to include the change in the disturbance area <br />and a design for the sediment control needed for this additional <br />disturbance area. <br />Please contact me if you or any other members of the Division have <br />any questions regarding this information. <br />Seneca Coal Company • P.O.
