Gunnison No. 1 mine. At that time, it was <br />determined that this would not constitute a mining plan modification. In <br />light of the September 1985 Interior Board of Land Appeals decision on the <br />t4 t. Gunnison Na. 1 mine, the Colorado Mined Land Reclamation Division (NERD) <br />has indicated that they will expand their analysis to include all anticipated <br />mining. This will include an analysis that requires leaving coal buffers <br />beneath and adjacent to some streams outside the existing mining plan ~ <br />approval area. Since these revisions would affect the conditions of the <br />mining plan approval pursuant to NEPA and would affect the future recovery of <br />leased Federal coal, it has been 3etermined that this will constitute a <br />mining plan modification under 30 CFR 746.18(d). <br />The Office of Surface Mining Reclamation and Enforcement (OSMRE) has <br />completed its initial review of the permit renewal application package and <br />the Colorado MLRD, preliminary adequacy review comments dated March 28, 1986, <br />and has no additional concerns at this time. <br />The Hureau of Land Management comments will be forwarded to you as soon as <br />they are available.
