Dear Mr. Shelton:
On January 17, 1986, West Elk Coel Company submitted an application for a
permit renewal for the Mt. Gunnison No. 1 mine. At that time, it was
determined that this would not constitute a mining plan modification. In
light of the September 1985 Interior Board of Land Appeals decision on the
t4 t. Gunnison Na. 1 mine, the Colorado Mined Land Reclamation Division (NERD)
has indicated that they will expand their analysis to include all anticipated
mining. This will include an analysis that requires leaving coal buffers
beneath and adjacent to some streams outside the existing mining plan ~
approval area. Since these revisions would affect the conditions of the
mining plan approval pursuant to NEPA and would affect the future recovery of
leased Federal coal, it has been 3etermined that this will constitute a
mining plan modification under 30 CFR 746.18(d).
The Office of Surface Mining Reclamation and Enforcement (OSMRE) has
completed its initial review of the permit renewal application package and
the Colorado MLRD, preliminary adequacy review comments dated March 28, 1986,
and has no additional concerns at this time.
