Lachhead <br />Eaecmrve Dvecuv <br />Michael B Long; <br />Divivon Dneaur <br />Enclosed please find copies of the Mined Land Reclamation Board's Findings of Fact, <br />Conclusion of Law, and Board Orders for the above mentioned notices of violation. Also <br />enclosed is a modification form for NOV C-94-012, to exclude the Northwest sediment trap. <br />During the Board hearing, the Board upheld the original amount of the assessed penalty <br />($750.00), and not the penalty resulting from the assessment conference ($500.00). Since Sun <br />Coal Company declined the settlement agreement offered as a result of the conference, and <br />elected to pursue the matter with the Board, the penalty of $500.00 (aheady paid byy Sun Coal <br />Company) no longer applies.
