As noted in the May 9 letter, this area is a
component of the lazger area covered by the pending Phase 1 bond release request submitted
on March 15, 1994. Kerr requests that you proceed with Phase 1 release of the bond assodated
with the 720 Pit area as a distinct component at this time only because of delays in resolving
separate bond release isrues relating to the Pit 1 azea.
It should be noted that Map 47A does not supersede [he previously submitted Map 47 but rather
serves az a rupplement. Consistent with the terms of the DMG/OSMRE/ICerr Settlement
Agreement and the recently approved technical revision (I'R-13), Kerr plans to initiate
supplemental backfilling and grading work in the Pit 1 area as soon as site conditions allow and
anticipates tha[ [he DMG will also proceed with processing of the remaining components of the
1994 bond release request in a timely manner. We appreciate your continuing responsiveness
and cooperation. Please feel free to con[act me with any questions regarding this submittal.
Bes[ regards,
TerraMatrix for Kerr Coal!,Com~panfy
Jerry M ettle[on
.n
cc: J.
