C-85-044. Mine No. 3. Permit No. C-84-062 <br />Dear Mr. Mathews: <br />Colorado Yampa Coal Company (CYCC) is submitting the following informa- <br />tion concerning the above referenced alleged violation which was issued to <br />CYCC on May 24, 1985. The alleged violation was issued for "failure to <br />promptly apply approved soil stabilizing practices to topsoiled areas in order <br />to control erosion." As of May 24, 1985, remedial action as addressed in the <br />alleged violation had been completed. This included contour furrows, diver- <br />sion ditches and the stabilization of all gullies greater than nine (9) inches <br />deep. <br />On October 1, 1984, CYCC initiated the topsoiling of the balance of the <br />area south of the Middle Creek office as required by Permit No. C-84-062, Mine <br />No. 3. Topsoiling did not occur until October due to the large amount of <br />reclamation which was underway at Energy Mine 1 and Eckman Park, Permit No. <br />79-177. Revegetation of the 25 acres at Mine 3 began on November 8th. The 25 <br />acres were chisel plowed, seeded and diversion ditches were installed. On <br />November 14th, weather conditions forced soil stabilization practices to <br />cease. CYCC made the decision to install diversion ditches as a remedial ac- <br />tion to control erosion on the area. CYCC planned to complete the approved <br />soil stabilization plan during the spring of 1985 as soon as weather and soil <br />conditions were acceptable. <br />On May 15, 1985, CYCC began the planned implementation of our soil stahi- <br />lization plan. Contour furrows were cut, gullies repaired and diversion <br />ditches reestablished. One gully was left untouched due to the appearance of <br />a spring from the undisturbed slopes above the reclaimed area. On May 23rd, <br />the CMLAD inspector toured this area and issued the alleged violation C-85-044 <br />on May 24, 1985. Concurrently, CYCC completed the soil stabilization of this <br />site prior to the N.O.V. being issued. The inspector was informed of the <br />circumstances that took place last fall and was aware that our stabilization <br />work was completed prior to the issuance of the N.O.V. <br />It is CYCC's opinion that it exercised sound reclamation practices in <br />accordance with the approved permit C-84-062. A rill and gully stabilization <br />plan will be implemented upon CYCC's submittal and with the CMLRD's approval. <br />The plan is scheduled to be submitted no later than July 31, 1985. <br />
