My comments are listed below. <br />Spoil Monitoring and Mitigation <br />The proposal submitted by the applicant is in general acceptable, but lacks <br />specificity with regard to sample depth, suitability criteria and method of <br />treatment. Unless CYCC submits alternative proposals with appropriate <br />technical documentation, I would recommend that the following stipulation be <br />imposed if the revision is approved. <br />STIPULATION: <br />THE PERMITTEE WILL SAMPLE THE UPPER 2 FEET OF MATERIAL WHEN OBTAINING <br />SAMPLES FROM REGRADED SPOILS WITHIN THE WOLF CREEK MINING BLOCK. <br />REGRADED SPOIL AREAS IN EXCESS OF TWO ACRES WHICH EXHIBIT pH VALUES BELOW <br />5.5 OR ACID-BASE POTENTIAL VALUES LESS THAN - 5 WILL BE COVERED WITH AT <br />LEAST FOUR FEET OF SUITABLE MATERIAL. <br />Topsoil Salvage and Redistribution <br />The applicant proposes to salvage all available topsoil with the exception of <br />designated steep slope areas (slope greater than 20 degrees). Topsoil <br />redistribution depth will be approximately 28 inches in the Wolf Creek Mine <br />area and 24 inches over the major portion of the Wadge Area. Two areas in the <br />Wadge Block totalling approximately 70 acres would be topsoiled to a depth of <br />6-10 inches, the varying topsoil depth being an attempt to enhance the habitat <br />diversity within the reclaimed area. <br />I would recommend that we accept the applicant's proposal, given the lack of <br />inhibitory materials in the Wadge overburden and the relatively small area <br />which will receive the shallow topsoil. <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
