© MWH <br />MONTGOMERYWATSON HARZA <br />October 16, 2002 <br />Mr. James Stazk <br />Colorado Division of Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: Hayden Gulch Mine, Permit No. C-80-003 <br />Transfer of Coal Permit and Succession of Operators <br />Dear Mr. Stark: <br />RE~~°~~~ED <br />ac~ z r zone <br />Division o/Minerals and GeDlogy <br />This letter serves as notice on behalf of H-G Coal Company (HGCC), pursuant to Rule 2.08.6 of <br />the Regulations of Colorado Mined Land Reclamation Board Division, of its intention to transfer <br />Coal Permit C-80-003 to Hayden Gulch Terminal, Inc. In support of this request, HGTI submits <br />the following information: <br />a) The apphcation form for Transfer of Coal Permit and Succession of Operators in <br />fulfillment of Rule 2.08.6(2)(6). The request of transfer is a result of HGTI desiring to <br />expedite title release to a parcel of land temporarily excluded from an Agreement for Sale <br />of Real Property. Under the agreement, HGCC was to retain title to this parcel until the <br />reclamation bond liability was released by the Colorado Division of Minerals and Geology <br />(CDMG). HGTI understands that the majority of the parcel has been released from the <br />reclamation bond liability, and desires title to the pazcel, knowing that it will assume the <br />remaining bond liability. <br />b) A Corporate Surety Reclamation Bond for the amount of $27,437.27 in fulfillment of Rule <br />2.08.6(2)(a). This bond is sufficient [o cover the remaining bond liability calculated by the <br />CDMG as part of Technical Revision No. 68. <br />c) The information required by 2.03.4, 2.03.5, 2.03.6, 2.03.7 (3), 2.03.9 and 2.03.10, which <br />fulfills the requirement of Rule 2.08.6(2)(6)(iii). <br />d) A copy of the proposed public notice that will be published in the Steamboat Pilot after <br />the CDMG has deemed the Permit Transfer Application complete.
