Modification to Section 16 Pit and Miscellaneous Drainage
Modifications
Dear Ms. Crosby:
The attached information is submitted as a request for a
Technical Revision to the Colowyo Permit C-81-019.
This Technical Revision addresses 1) a modification to the
timing and extent of Section 16 mining; 2) post mining topography
modifications to Section 16; and 3) general post mining drainage
modifications.
Because this permit modification combines a number of minor
alterations to the overall reclamation plan and design changes to
regulated facilities (drainages), Colowyo believes it is
appropriate to submit this request as Technical Revision. This
revision proposes no new areas for mining nor any additions to the
permit area.
SECTION 16 PIT
Technical Revision Item #1 Section 16 South Minincx Area
When Permit C-81-019 was modified to include the mining of
Section 16 (PR-O1), Colowyo was not the holder of Federal Coal
Lease C-29226 (see Map 1 - Coal Ownership) which is located, in
part, immediately south of Section 16. Colowyo also did not have
approvals for disturbance of the BLM surface immediately south of
Section 16 other than for the sediment control ditch and a
perimeter fenceline.
In order to keep mining related disturbance located entirely
within Section 16, the southerly extent of the mining pits were
artificially shortened so as to provide for the topsoil removal
buffer and the pit south end wall. This resulted in our inability
to mine approximately 40,000 tons of State of Colorado Coal Lease
257/135.
Since the approval of PR-O1, Colowyo has obtained ownership of
C-29226 (see the attached BLM approval of the lease assignment to
Colowyo for inclusion into Exhibit 1). By virtue of ownership of
C-29226, Colowyo is also granted the right to disturb, for mining
related purposes, the BLM surface associated with the coal lease.
