This <br />revision proposes no new areas for mining nor any additions to the <br />permit area. <br />SECTION 16 PIT <br />Technical Revision Item #1 Section 16 South Minincx Area <br />When Permit C-81-019 was modified to include the mining of <br />Section 16 (PR-O1), Colowyo was not the holder of Federal Coal <br />Lease C-29226 (see Map 1 - Coal Ownership) which is located, in <br />part, immediately south of Section 16. Colowyo also did not have <br />approvals for disturbance of the BLM surface immediately south of <br />Section 16 other than for the sediment control ditch and a <br />perimeter fenceline. <br />In order to keep mining related disturbance located entirely <br />within Section 16, the southerly extent of the mining pits were <br />artificially shortened so as to provide for the topsoil removal <br />buffer and the pit south end wall. This resulted in our inability <br />to mine approximately 40,000 tons of State of Colorado Coal Lease <br />257/135. <br />Since the approval of PR-O1, Colowyo has obtained ownership of <br />C-29226 (see the attached BLM approval of the lease assignment to <br />Colowyo for inclusion into Exhibit 1). By virtue of ownership of <br />C-29226, Colowyo is also granted the right to disturb, for mining <br />related purposes, the BLM surface associated with the coal lease. <br />
