Long <br />Drv mun Direcbr <br />RE: Citizen Complaint, Damage to the Chavez property, Las Animas <br />County, Golden Eagle Mine, ,'XC-81-013 <br />Dear Mr. Chavez: <br />The Division of Minerals and Geology (Division) has completed <br />review of the items listed in your letter sent to Robert Montgomery <br />of Western Energy Company dated April 17, 1996, concerning your <br />estimate of damage incurred to your property. As you are aware, <br />our letter to you dated April 26, 1996 deferred responses on two <br />items listed in your letter to allow the Division time to review <br />the facts and history related to the specific areas of concern. <br />For your convenience, I have listed below our initial response to <br />those concerns where the Division required additional time for <br />investigation and review. <br />2. (second sentence) Replacement of topsoil and eroding side <br />ditches caused by removal of the coal slag with the backhce <br />and to also include replacement and reseeding of new ditches <br />formed and to clean the entire ditch to headgate to opposite <br />end approximate cost of $7,080. <br />The Division is still evaluating whether there is any <br />remaining mine liability for those areas that were repaired or <br />altered as part of the abatement of NOV ,~C-94-008. As for <br />clean out of the length of ditch west of that portion which <br />was involved with the NOV and subsequent clean up, this again <br />is a property rights dispute and should be resolved by dealing <br />directly with the mine. The Division will not consider <br />further issues associated with the irrigation ditch above the <br />location of mine culvert C-14 on mine ditch D-13. <br />Upon review of the Notice of Violation #C-94-008 and from the <br />observations made during the field inspection conducted in April, <br />the Division does concur that there is some evidence that the work <br />conducted initially by Basin Resources did not restore the ditch <br />
